PRIVACY POLICY

This is the privacy policy of “BRUSTOR NV” (hereinafter “BRUSTOR” or “we”).

This privacy policy is designed to inform you about the personal data BRUSTOR collects through its websites, contact forms or professional data providers, to explain why we collect these data and how we process them.

1              SCOPE OF THIS PRIVACY POLICY

This privacy policy applies to the processing of your personal data, which BRUSTOR collects through its websites, contact forms or professional data providers, barring its jobsites, for which a separate privacy policy applies.

2              WHO IS RESPONSIBLE FOR THE PROCESSING OF YOUR PERSONAL DATA?

BRUSTOR is responsible for the processing of your personal data. This means that BRUSTOR decides for which purposes and with which resources your personal data are processed.

BRUSTOR has appointed a data protection officer, who is your point of contact for all questions or requests regarding the processing of your personal data. You can find the contact details of this data protection officer under Article 13 of this privacy policy.

3              WHICH PERSONAL DATA DO WE PROCESS ABOUT YOU?

We collect your personal data in three ways:

3.1          INFORMATION PROVIDED BY YOU

In first instance we receive your personal data when you share them with us. This is the case for example when you fill out a form on our websites or at a trade show, when you request a brochure or a sample, when you request an appointment with a showroom or a dealer, when you participate in a contest, when you subscribe to our newsletter or a specific promotion, request a quotation, and so on.

In that case, we generally receive data, such as your name, your e-mail address, phone number, address (street, number, post code, city, country), date of birth, a date for a meeting and other personal and/or contact details.

We may also request that you provide comments, suggestions or other information about our websites, products, services or companies.

3.2          AUTOMATICALLY OBTAINED INFORMATION

When you use our websites, we collect information about your activity on our websites, using cookies, such as the webpages you view, the products that interest you, and so on. This information cannot be used to identify you. This means that we have no idea who you are based on this automatically obtained information. We can however collate this information with the information we obtained from you.

3.3          INFORMATION OBTAINED FROM THIRD PARTIES

Sometimes we receive your information, including for example information about your specific construction or renovation projects, from partner companies or professional data providers (e.g., construction trade shows, distributors, and so on). They often provide us with such data as your name, your e-mail address and your projects.

BRUSTOR obtiene datos personales como resultado de la utilización de la aplicación "3rd party VirtualSaleslab" en su página web.  Estos datos se almacenan tanto en brustor.com como en la propia aplicación durante un periodo de tres meses. Después de este periodo, los datos se eliminan automáticamente tanto en brustor.com como en la aplicación del Laboratorio de Ventas Virtual.

4              HOW DO WE PROCESS YOUR PERSONAL DATA?

BRUSTOR processes your personal data for different purposes, which are explained in further detail below. We do not, however, process your personal data without a legal ground.

-         The legal ground may be consent. In some cases (e.g., for personalised information), we will request your explicit consent. In other cases, your consent may be based, for example, on ticking a box regarding the processing of your personal data during your visit to our websites, or through another positive action or behaviour, from which your behaviour can be deducted, e.g., by contacting us using a contact form on our websites. In that case, you have the right to withdraw your consent at any time.

-         The processing can also be based on another legal ground: e.g., when the processing of your personal data is required to execute an agreement or to comply with a legal obligation, which BRUSTOR must respect. The processing of your personal data may also be necessary to satisfy a legitimate interest of BRUSTOR. In that case, we will examine whether your interests or your fundamental rights and freedoms take priority.

If BRUSTOR wishes to process your data for purposes that are irreconcilable with the purposes set out below, it shall inform you about this.

5              FOR WHICH PURPOSES DO WE PROCESS YOUR PERSONAL DATA?

5.1          TO SEND YOU PERSONALISED INFORMATION AND PROMOTIONS BASED ON YOUR PROFILE IF YOU HAVE EXPLICITLY CONSENTED TO THIS.

We process your personal data based on your consent to manage your participation in contents, activities or other promotional offers or to send you personalised information or promotions.

We usually receive personal data such as your name, address, e-mail address, phone number, your language preferences, the project or region in which you are interested and/or your credit card or other payment data for these purposes.

If you consent to this, we will create a profile for you, based on your purchasing behaviour, which takes into account your preferences and interests, e.g., the products you buy and other products that might interest you. Based on the information collected in your profile, we can send you information and promotions about products that match your profile or products that we think might interest you, in addition to other general information and promotions. In every e-mail we send you we give you the option to unsubscribe. You can also contact us about this at any time (see Article 10 of the privacy policy regarding the right of objection).

Depending on each individual case, these personal data are processed based on your explicit consent in line with the execution of an agreement of which you are a party or based on your request to take measures prior to concluding an agreement.

5.2          TO EXECUTE YOUR ORDER OR ANSWER YOUR QUESTIONS OR REQUEST.

We also process your personal data to reply to your questions or requests (e.g., request for a brochure, to send you the results of your favourite BRUSTOR product, to make an appointment with one of our salesmen or to arrange a visit to our showroom, and so on). If you order a product, we will process your personal data to deliver the product to you.

For this purpose, we usually receive such personal data as your name, your e-mail address, your phone number, your address, your correspondence with BRUSTOR and all other personal data which you provide, which may be relevant for responding to your question.

Depending on each individual case, these personal data are processed based on your request to take measures prior to concluding an agreement, in line with the execution of an agreement of which you are a party or based on BRUSTOR’s legitimate interest to inform you of its activities.

5.3          TO SEND BRUSTOR DIRECT MARKETING MAIL

We also process your personal data to keep you informed of new information, actions and promotions about our brands and our companies (direct marketing), by e-mail, text message or post. In addition to this, we process your personal data to provide information about the properties, services and products of BRUSTOR. These personal data are processed based on BRUSTOR’s legitimate interest.

For this purpose, we often process such data as your name, e-mail address, phone number and address.

If you have previously sent us a request, e.g., for information or to receive a sample or make an appointment with us or if you have previously ordered a product, we will gladly continue to provide information about our products to you. Do you not/no longer wish to receive this information? No problem, in every e-mail we send you we give you the option to unsubscribe. You can also contact us about this at any time (see Article 10 of the privacy policy regarding the right of objection).

5.4          FOR THE TECHNICAL AND FUNCTIONAL MANAGEMENT OF OUR WEBSITES

We process your personal data as part of the technical and functional management of our websites, to personalise these websites and guarantee that our websites are user-friendly.

For this purpose, we usually process such data as your IP address, the webpages you have viewed, the websites you previously visited, geographical data such as your location, your language preferences and the time and duration of your visit. We do this among others with cookies.

Depending on each individual case, we process these personal data based on your explicit consent or based on BRUSTOR’s legitimate interest to improve its websites and protect them against cyberattacks.

6              WITH WHOM DO WE SHARE YOUR DATA?

BRUSTOR is very selective about the parties with whom it shared your personal data and makes a rigorous selection. In all cases, we will ensure that sufficient guarantees are provided about the protection and confidentiality of your personal data.

We communicate (some of your) personal data to third parties in the following cases:

  • BRUSTOR sales personnel (showrooms) and dealers, so they can contact you for example to arrange a meeting.
  • Some data processors, that act on our behalf, e.g., marketing and communication companies.
  • Partner companies and other associated companies of BRUSTOR.
  • Business partners, such as third parties with whom we organise joint programmes or promotions.
  • IT service providers that provide technical support.
  • Providers of payment services.
  • Solicitors or consultants: in certain cases, BRUSTOR can pass on your personal data to external consultants or solicitors if this proves necessary, to give advice or to defend BRUSTOR’s interests in legal proceedings.
  • Governments: depending on the situation, we may disclose your personal data to police, judicial or other supervisory authorities if we feel that we are obliged to do so, by law, regulation or another legal request or injunction.
  • Possible subsequent acquirers of the company: in the unlikely event that a third party acquires our company, whether in part or in whole, your information will be transferred to the acquiring party.

7              DOES BRUSTOR PROCESS YOUR PERSONAL DATA OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)?

Your personal data may be processed by a party outside the EEA for the purposes set out in Article 5.

In the event that this occurs, BRUSTOR shall always ensure that an adequate and sufficient level of protection is observed to protect your personal data, in particular by referring to an adequacy decision based on Article 45 of the General Data Protection Regulation (GDPR), by concluding standard provisions on data protection based on Article 46 of the GDPR or by requesting any other appropriate guarantee.

8              HOW DO WE SECURE YOUR PERSONAL DATA?

We ensure that your personal data are protected by the appropriate administrative, technical and organisational measures. BRUSTOR has developed various procedures for its employees to ensure this.

In addition to this, BRUSTOR ensures that the service providers that process personal data on behalf of it, also implement the required technical and organisational measures.

9              HOW LONG DO WE RETAIN YOUR PERSONAL DATA?

BRUSTOR will only retain your personal data for as long as necessary to achieve the objectives for which your personal data were collected, unless a longer data retention period is required or allowed by law.

If no legal data retention period applies, BRUSTOR will at least process your personal data for as long as required for the execution of an agreement, of which you are a party.

10           WHAT ARE YOUR RIGHTS AND HOW CAN YOU EXERCISE THEM?

You have a number of rights with regard to your personal data. Some of these rights have a very specific scope or are subjected to very specific conditions or exceptions.

10.1        RIGHT TO ACCESS

This means you can ask us among others whether we process personal data about you, for which purposes we do this and so on. For more information, see article 15 of the GDPR.

10.2        RIGHT TO RECTIFY

In addition, you have the right to have your personal data rectified if they are incorrect or incomplete. You can find more information about this right in Article 16 of the GDPR.

10.3        RIGHT TO BE FORGOTTEN

In certain cases, you can also request that your personal data be deleted. You have this right, among others, when your personal data are no longer required for the purposes for which we collected them, when we process your personal data based on your consent and you withdraw this consent, and so on.

In certain exceptional cases, BRUSTOR is not obliged to act upon this. You can find more information about this right in Article 17 of the GDPR.

10.4        RIGHT TO LIMIT THE PROCESSING OF YOUR PERSONAL DATA

In some cases, you can also limit the processing of your personal data. You can, among others, request a limitation of your personal data, if you dispute the correctness of your personal data, if the processing is unlawful and so on. Limiting the processing of your personal data means that we may only temporarily retain your personal data, except if you consent to our processing of your personal data, as part of a legal claim or in the general interest. A limitation may be subsequently abolished. You can find more information about this right in Article 18 of the GDPR.

10.5        RIGHT TO TRANSFERABILITY OF YOUR PERSONAL DATA

You can request a transfer of your personal data among others, when the data processing is based on your consent or an agreement which you concluded with us (if technically possible). In certain exceptional cases, BRUSTOR is not obliged to act upon this. You can find more information about this right in Article 20 of the GDPR.

10.6        RIGHT TO OPPOSE

You can always inform us of special reasons why you wish to oppose the processing of your personal data, which is based on the general or legitimate interest of BRUSTOR. If these reasons outweigh our interests, we can stop all data processing. BRUSTOR cannot agree to this request if your personal data are related to a legal claim. 10.7        RIGHT TO OPPOSE IN THE FRAMEWORK OF DIRECT MARKETING

If we process your personal data for direct marketing purposes, you can always request that we stop doing this, without citing a specific reason. You can find more information about this right in Article 21 of the GDPR.

10.8        RIGHT TO NOT BE SUBJECTED TO PROFILING

BRUSTOR will not process your personal data for profiling purposes unless you give your explicit consent to this (see Article 4 and 5 of this privacy policy). That is why we let you choose whether you wish to receive personalised information and promotions when filling out a form. In such cases, BRUSTOR will ensure that there is sufficient human intervention or that you have the right to share your point of view. You can find more information about this right in Article 22 of the GDPR.

10.9        RIGHT TO WITHDRAW CONSENT

When the processing of your personal data is based on consent, you always have the right to withdraw this consent. When you withdraw this consent, this shall have no impact on the validity of the processing of your personal data prior to the withdrawal of this consent.

10.10     EXERCISE OF THE AFOREMENTIONED RIGHTS

Exercising the aforementioned rights is very easy. Moreover, you can choose which method suits you best: by e-mail, by post, using the contact form on our websites or customer services in your favourite BRUSTOR shop. For reasons of privacy and security, we shall take reasonable measures to check your identity before fulfilling your request.

10.11     COMPETENT SUPERVISORY AUTHORITY

In accordance with Article 77 of the GDPR, you have the right to lodge a complaint with the supervisory authority of your place of residence, your place of work or the place where the alleged infringement was committed. 11           WHAT ABOUT LINKS TO OTHER WEBSITES AND SOCIAL MEDIA?

The BRUSTOR websites may contain links to other websites, which are provided by other companies or by social media. BRUSTOR cannot be held liable for the processing of personal data through these websites, nor does this privacy policy apply to these websites. BRUSTOR recommends that you check the privacy policies of these companies.

If you share the content of a BRUSTOR website on social media, your personal data will be visible for the visitors of these social media. Nor can BRUSTOR be held liable for the processing of your personal data. In addition, this privacy policy does not apply in this case.

12           HOW TO KEEP INFORMED ABOUT CHANGES TO THIS PRIVACY POLICY?

This privacy policy was last updated on 25 May 2018.

We always strive to offer you the best service. That is why this privacy policy may be amended. You can always find the latest version of the updated privacy policy on our websites. In addition to this, we always strive to inform you of important changes through other communication channels.
